TERMS AND CONDITIONS OF SALE
Welcome to archivioantidoto.com (the site). By accessing and using the site and/or making a purchase, you accept these terms and conditions of sale.
We also recommend that you read the terms and conditions of use, the privacy policy, and the information regarding the use of cookies.
1. GENERAL INFORMATION
1.1 This website is operated by the sole proprietorship Antidoto di Guzzo Valentina (seller) with its registered office at via S. Mamete 50/a, 20128 Milan. VAT number 13915870961.
On the website, you will find information on terms of sale, returns, and shipping, as well as the privacy policy in the appropriate sections.
For any further information, you can write to info@archivioantidoto.com.
The seller reserves the right to modify or update these terms, which will become binding upon publication on the website.
1.2 The seller offers for sale used and vintage clothing and accessories intended for purchase by consumers.
Under Legislative Decree No. 206 of 6 September 2005 (Consumer Code), a consumer is defined as a natural person who purchases, uses, or benefits from our products or services for purposes not related to professional or business activities. In other words, the consumer is someone acting for purposes that do not fall within their commercial, craft, or professional activities.
Therefore, the provisions concerning consumer rights (including the right of withdrawal under Article 52 of the Consumer Code and legal warranties as described in the relevant legislation) apply exclusively to buyers who are consumers, as defined by Italian law.
If the purchase is made for professional or commercial purposes, the buyer will not be considered a consumer and will not be entitled to the provisions in favor of consumers under applicable laws.
These terms of sale, along with the order confirmation (see point 3 below), represent the contract for the supply of consumer goods between the seller and the buyer. No other conditions or terms may apply.
The seller may make changes to the terms at any time. The buyer is therefore required to accept only the terms in effect at the time of purchase.
2. PRODUCTS AND DESCRIPTIONS
2.1 All products sold on this site are used and/or vintage items, which means they may show signs of wear due to age. These conditions will be specified in the product description.
2.2 Photographs allow us to provide accurate details of the items for sale, but we cannot guarantee that the colors displayed on your monitor are accurate. The images are for reference only.
3. ORDERS
3.1 By adding one or more items to the cart, you will be able to review and modify its contents.
Each product is accompanied by a card outlining its main features.
The presence of a product on the website implies its availability at the time of purchase.
Given that these are unique vintage products, it is possible that if multiple users visit the site at the same time or within a short time frame, simultaneous or closely timed views and purchases may result in the product no longer being available. In such cases, we will inform you and proceed with a refund of any amount paid.
For the correct formal submission of the order in electronic format, you will be asked to provide the necessary data for order fulfillment, including your name, surname, address, and tax code, all mandatory for invoicing (the tax code is also necessary to verify the consumer's age).
3.2 By completing an order, you agree to and accept the terms and conditions of sale, the terms and conditions of use, and the privacy policy of the site, and declare that you have reached the legal age.
3.3 Upon receiving the order, we will verify the data and send you an order confirmation to the email address provided. From this moment, the sales contract will be considered concluded, and these terms will apply.
Orders with incomplete or inaccurate data cannot be processed. Archivio Antidoto will not be held responsible for any consequences (e.g., failure to process the order, delays, etc.) due to incorrect or incomplete information provided by the consumer when completing the order.
In any of the above cases, it will be Archivio Antidoto's responsibility to inform the consumer that the contract has not been concluded and that the order has not been processed, specifying the reasons.
3.4 We will process the order as quickly as possible, typically within 1 to 5 business days from receipt of confirmation.
4. PRICES AND PAYMENTS
4.1 The prices of the products are expressed in euros and include VAT.
Shipping fees and any other additional charges, not included in the product price as listed in the description, are detailed in the shipping section and summarized before the consumer submits the order.
4.2 During checkout, you will be able to choose your preferred payment method. Payments made through our website are secure and protected, thanks to the use of advanced encryption technologies.
4.3 Prices on the website are subject to change. Always check the final price displayed during checkout before submitting your order.
4.4 The transfer of ownership of the product from the seller to the buyer occurs only upon full payment of the indicated price. Partial payments or installment proposals will not be accepted and will not bind Archivio Antidoto.
5. SHIPPING AND DELIVERY
5.1 We ship to Italy and some foreign countries, with the following detailed table and associated rates.

5.2 Delivery times vary and depend on the selected carrier. Typically, we entrust the shipment to the carrier within 5 business days from order receipt. After this operation, you will receive the tracking code to monitor the shipment.
5.3 It is the consumer's responsibility to provide a correct shipping address. The seller is not responsible for errors due to incorrect information provided during the purchase.
In case of delivery issues, we will contact you to provide the carrier with correct instructions for handling the goods.
5.4 Any additional costs for storage, handling, or customs operations, including taxes, duties, and penalties, will be your responsibility. If you fail to pay these expenses, the seller will be forced to pay them on your behalf and will then request reimbursement from you.
Any additional costs charged to the seller by the carrier will be passed on to you.
In case of non-pickup by the consumer, and the subsequent return of the goods to the seller by the carrier, the seller will refund the amount paid, minus any handling fees charged by the carrier.
5.5 For orders from countries outside the European Union, it is your responsibility to contact the local customs office to determine the amount of customs duties that will be your responsibility. The purchase will only be completed after payment of these duties to the carrier, who will withhold the goods until payment is made.
6. RISK TRANSFER
6.1 As stated above, Archivio Antidoto makes deliveries to the specified address via specialized carriers.
The seller will not be held responsible for any damage or defects caused during transport and delivery by the carriers.
6.2 The buyer is advised, if receiving a damaged package, to accept the delivery "with reserve" in order to obtain subsequent compensation from the carrier and allow the seller the same protection from the carrier.
7. RIGHT OF WITHDRAWAL AND RETURN POLICY
The right of withdrawal is governed by the Consumer Code, Article 52 et seq. of Legislative Decree 206/2005.
The consumer has a period of fourteen (14) days to withdraw from the purchase contract with the seller for the goods purchased on the site, without providing any reason.
7.1 To return an item, you must send an email to info@archivioantidoto.com within fourteen (14) calendar days from the day after receiving the product, informing us of your intention to return the goods.
7.2 The return is accepted only if the product is in the same condition as when received, with the original labels and in its original packaging.
7.3 The return costs are borne by the consumer.
7.4 If the return is accepted, the seller will refund the amount paid, minus the shipping fees, within fourteen (14) calendar days.
8. LEGAL WARRANTY OF CONFORMITY
8.1 Pursuant to the Consumer Code, the seller is obliged to provide the consumer with the legal warranty for defects and discrepancies of the purchased product.
In this regard, it is reminded that the products sold on the site are vintage goods, which may therefore naturally present defects related to wear and the aging of the product itself. These defects will be indicated in the product description but cannot, in any case, be considered as defects.
8.2 Given the nature of the products sold on the site, the consumer acknowledges that, due to their uniqueness, in the case of a legitimate claim for an innocent defect/non-conformity, excluding those prior to the period mentioned, it may be impossible for the seller to proceed with the repair or replacement of the product. It is understood that in this case, the full price paid will be refunded and the defective product will be requested to be returned.
